Terms & Conditions
1. General
a. Members will be bound by these terms and conditions when joining Honourable Law Plan.
b. Honourable Law Plan reserves the right to make changes to these terms and conditions at any time.
2. Membership Policy
a. Only applications completed correctly and paid in full will be granted membership.
b. We reserve the right to verify the details submitted to obtain a membership.
c. Honourable Law Plan may require additional information before granting a membership.
d. Applications may be declined if details submitted are not adequate.
e. A family membership is an individual or two individuals in a relationship inclusive of their dependant children up to the age of 24 living at the same residential address.
f. A family membership also includes same sex couples inclusive of their dependant children up to the age of 24 living at the same residential address.
g. A family membership will also include dependants with any disabilities of any age who are living at the same family residential address.
h. Memberships may be cancelled before the duration stipulated if the membership is being utilised by unauthorised users. A refund will not be given.
i. You must be at least 18 years old to submit an application for membership with Honourable Law Plan.
j. You must be the legal owner of the credit card being used to make payment for a membership.
k. Your receipt of an electronic or other form of confirmation does not signify our acceptance of your application.
l. Honourable Law Plan reserves the right at any time after the receipt of the application to accept or decline for any reason.
m. Honourable Law Plan does not suspend memberships.
n. Membership commences from the date of payment and does not cease until the expiry date is reached.
o. The member agrees and understands that they are entering into a binding contract by electronically accepting the Terms & Conditions.
p. Membership cards remain the property of Honourable Law Plan3. Renewal Policy
a. Members choosing to 'automatically renew' will be charged for renewing using the credit card supplied.
b. Members renewing must supply Honourable Law Plan with current credit card details to process their renewal.
c. Members choosing to 'automatically renew' will be posted new membership cards prior to expiry.
d. Members choosing to 'automatically renew' will save 25% off their membership fee when renewing.
4. Refund Policy
a. Refunds are given in the event the member is not satisfied with Honourable Law Plan.
b. Members can receive a refund if sought within 30 days of their joining date.
c. Refund requests must be made via email.
d. Members must supply reason/s for seeking refund, name of participating lawyer visited, copy of receipts with services and return membership card/s to Honourable Law Plan, PO Box 943, Kenmore Brisbane QLD 4000.
e. Refunds are not granted if the reason for the refund request is related to the Solicitor, Legal practice, or servicest as this should be addressed with the legal practice directly.
f. Honourable Law Plan are not permitted to discuss your situation with the legal practice and the legal practice is not permitted to disclose any details to Honourable Law Plan due to privacy legislation.
g. Refunds are not granted if the membership simply has not been used or is no longer of use.
h. A member that has been granted a refund may not be entitled to a refund in the event that they join again.
i. Honourable Law Plan may refuse to accept a future membership application from a member who has sought a refund in the past.
j. A refund is at the discretion of Honourable Law Plan.
4. Member Responsibilities
a. You are responsible for ensuring that all application details provided to Honourable Law Plan is correct.
b. Necessary updates of these details must be made promptly using the Member Log-in located at the site.
c. You must ensure to inform the participating dental practice that you are a member of NobleDentist when making an appointment.
d. You must present your membership card to the reception on arrival at the practice.
e. You must ensure that you will not allow any unauthorised use of membership by third parties.
f. You must ensure to report the loss or theft of your membership card to Honourable Law Plan.
g. Members must ensure that membership cards are kept securely and in good condition.
h. Participating dentists and staff must be able to ascertain necessary information from the membership card.
i. Replacement membership cards will incur a service charge to the member of $24.95.
5. Fee Schedule
a. Members attending participating Lawyers are entitled to legall fees in accordance with the Honourable Law Plan Fee Schedule.
b. Legal fees for any dental services not included in the Honourable Law Plan Fee Schedule are reduced by 15%.
c. Dental fees for any legal services performed by a participating lawyer who is a specialist are reduced by 7.5%.
d. The Honourable Law Plan Fee Schedule is subject to change without notice.
6. Payment Terms
a. Memberships will last for 12 months from the date of payment.
b.Honourable Law Planmay offer memberships that last for longer periods for promotional reasons.
c. Memberships will be based on individual, couple, and family coverage.
d. Credits cards can be used to pay for memberships.
e. Visa, MasterCard, and American Express will be used via the Bank of Queenslandt payment system.
f. Honourable Law Plan does not store or record credit card numbers.
g. Secure transmission is made directly through Bank of Queensland payment system.
h. We receive and display a response to your transaction which is also sent to you via your registered e-mail address.
i. Honourable Law Plan does not issue membership until a successful payment has been confirmed.
j. Honourable Law Plan will have the right to refuse or cancel any applications placed for memberships at the incorrect price in the event a membership is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information.
k. Honourable Law Plan shall have the right to refuse or cancel a membership application whether or not the application has been confirmed and your credit card charged.
l. Honourable Law Plant shall immediately issue a credit to the credit card account in the amount of the charge if your credit card has already been charged for the purchase and your Application is cancelled.
m. Honourable Law Plan may also accept other methods of payment at their discretion.
n. These include payment over the telephone, direct deposits, cheques and money orders.
7. Membership Renewal
a. Honourable Law Plan will give notice via mail, email, or telephone that your membership will be expiring prior to the expiration date identified in your membership confirmation.
b. It is the responsibility of members to supply Honourable Law Plan with current payment information to process the membership renewal.
c. In all events it is the responsibility of the member to ensure that Honourable Law Plan has received payment for membership prior to the expiration date identified on the membership card.
d. Honourable Law Plan is not responsible and assumes no liability to any member for failure to provide NobleDentist with current payment information for membership renewal.
8. Exclusion of Warranties
a. Honourable Law Plan can not guarantee continuous, uninterrupted access to the website or links within the website.
b. Operation of this website and our services may be interfered with by numerous factors including ones outside our control.
c. Best efforts will be made to ensure that interruptions are minimised.
d. Rest assured Honourable Law Plan will work diligently to rectify technical problems.
e. Honourable Law Plan provides this service without any warranty or condition, express or implied.
f.Honourable Law Plan expressly excludes all warranties of any kind including any implied warranties as to fitness of purpose or merchantability of this service or that using this service will not result in infringement of third party rights.
g. Honourable Law Planmakes no warranty that the services provided by us will be timely or error free.
9. Limitation of Liability
a. Honourable Law Plan will not be liable for any lost profit or any direct, indirect, incidental, special or consequential loss or damage related to your use of the Honourable Law Plan website and other services.
b. Honourable Law Plan makes no guarantees or representations regarding products or services sold on the Honourable Law Plan website unless expressly stated.
c. Honourable Law Plan is not liable for any typographical errors which appear in on the website regardless of whether the relevant error is our responsibility.
d. Honourable Law Plan expressly disclaims all warranties express or implied of any kind with respect to products sold on this website including but not limited to merchantability and fitness for a particular purpose except as expressly stated.
e. You agree that the sole and exclusive maximum liability to Honourable Law Plan arising from any product sold on the Honourable Law Plan site shall be the price of the membership.
10. Indemnity
a. You agree to indemnify us and our subsidiaries, related companies, officers, directors, employees and agents harmless from all liability.
b. This includes liability in connection with infringement of a third party’s intellectual property right or moral right and negligence.
c. This also includes any claim in connection with these terms, site, or use of the site and our services.
11. Security Matters
a. Honourable Law Plancollects personal information from people in order to grant membership.
b. Membership will not be granted without this information.
c. We may contact you to ascertain particulars that would improve the services provided to members.
d. Honourable Law Planwill not disclose your information to third parties.
e. Information may be used by us in order to improve services provided to members and visitors to the site.
f. Reference can be made to the Privacy Policy for a detailed explanation of the use of personal information.
g. Participating lawyers responsible for administering treatment will need to sight the membership card.
h. Picture identification may also be requested from the participating dentist to confirm the identity of the member.
i. You must keep your membership card securely to prevent use by an unauthorised third party.
j. Any misuse of membership may result in termination of membership. No refund will be given.
12. Governing Law
a. These Terms and your dealings with Honourable Law Plan are subject to the laws of Queensland, Australia.
